障害者マークは車椅子以外にもある。"Miscellaneous Provisions"とは?

日本では、障害者マークは車椅子のものが一般的ですが、アメリカのADA(Americans with Disabilites Act)には、次のようなマークがあります。




では、アメリカ障害者法(ADA)の第4章と第5章の内容です。


Title IV (Telecommunications)   第4章(通信)
This title requires telephone and Internet companies to provide a nationwide system of interstate and intrastate telecommunications relay services that allows individuals with hearing and speech disabilities to communicate over the telephone. 


電話やインターネットの会社は、聴覚障害や言語障害がある人たちが電話を使って通信を行うことができるように、州内外のシステムを国家規模で整備しなければならない。


This title also requires closed captioning of federally funded public service announcements. This title is regulated by the Federal Communication Commission. 


また、国家予算で行われる公共アナウンスメントには、字幕を付けなければならない。このことは、連邦コミュニケーション委員会によって定められているものである。


Title V (Miscellaneous Provisions)   第5章 (雑則)
The final title contains a variety of provisions relating to the ADA as a whole, including its relationship to other laws, state immunity, its impact on insurance providers and benefits, prohibition against retaliation and coercion, illegal use of drugs, and attorney’s fees. This title also provides a list of certain conditions that are not to be considered as disabilities.


最終章には、全体としてADAに関連した様々な条項が含まれている。その中には、他の法律との関連性、国への免責事項、保険会社への影響や特典、報復・強制、薬物の違法使用の禁止、そして弁護士費用まで含まれている。また、障害と見なされない場合のリストも示している。


"Miscellaneous Provisions"は、「その他色々な項目」という意味です。

Introduction
On January 1, 2009, the Americans with Disabilities Act Amendments Act (ADAAA) of 2008 went into effect, making some major changes to the definition of disability. The changes apply to both the ADA and the Rehabilitation Act. The following information provides an overview of some of the main changes. 


序章
2009年1月1日、2008年の「修正アメリカ障害者福祉法(ADAAA)」が施行されました。障害の定義にいくつか大きな変更がなされました。この変更はADAとリハビリテーション法に適用されます。大きな変更の概要については次にあげます。


DEFINITION OF DISABILITY
The ADAAA did not change the wording of the definition of disability, but it changed the meaning of some of the words used in the definition and the way they are applied. 

(1) Disability.—The term "disability" means, with respect to an individual
A. A physical or mental impairment that substantially limits one or more major life activities of such individual;
B. A record of such an impairment; or
C. Being regarded as having an impairment.

「障害の定義について」ADAAA(修正アメリカ障害者福祉法)は障害についての文言や定義に変化はないが、いくつかの文言の定義や適用についてその意味を変更した。
(1) 障害ーーここの「障害」という言葉は、障害を持った人の権利に配慮し、次のように解釈するものである。
A. 日常生活をするにあたって、一つ以上の大きな制限が加わってしまう身体的精神的な機能障害のこと。 

B.  今までにこうした機能障害があったということ。
C. 機能障害があるとみなされていること。


障害については、多岐に渡っており、また、状態や状況によって、障害と見なすか見なさないかの境目もはっきりしていない場合があり、障害という言葉自体も時代に合わせて、共通理解が異なってきます。しかし、修正が加わっても変わらないのは、障害を持つ人に配慮する、気持ちを傾ける---"with respect to an individual"ということ(英文内の下線部)です。


"respect"ロングマンで2つの定義があります。
"respect"
 to admire someone because they have high standards and good qualities such as fairness and honesty 
レベルが高かったり、公正で正直などといった性質ゆえに、そうした人を尊敬すること。


to be careful not to do anything against someone’s wishes, rights etc
相手の望みや権利などに反した行動をしないように注意すること。


障害者法に使われている"respect"は②です!
